Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the mobile application (“App”) and related services (collectively, the “Services”) provided by Playersbest, Inc. (“Playersbest,” “we,” “us,” or “our”). By downloading, installing, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Eligibility

You must be at least the age of majority in your jurisdiction of residence to use the Services. By using the Services, you represent and warrant that you meet this requirement and that all information you submit is accurate and truthful.

1. Registration: In order to access certain features of the Services, you may be required to create an account. You agree to provide true, accurate, current, and complete information and to keep this information up to date.
2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or breach of security.

3. Use of the Services

1. License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device for your personal, non-commercial use.

1. Earning Points: You may earn loyalty points (“Points”) through qualifying purchases or actions as described in the App.
2. Redeeming Points: Points may be redeemed for certain rewards or benefits, subject to additional terms disclosed in the App or by our partners.
3. No Cash Value: Points have no cash value, cannot be transferred, and do not constitute property.
4. Expiration of Points: We reserve the right to set expiration dates for Points or to modify the terms under which Points are earned or redeemed.

5. Intellectual Property

All content, features, and functionality available through the Services, including text, graphics, logos, icons, images, and software, are the exclusive property of Playersbest or its licensors and are protected by intellectual property laws. You may not use any trademark, logo, or other proprietary information without our express written consent.

6. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, PLAYERSBEST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PLAYERSBEST, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

1. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
3. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR DATA.

8. Indemnification

You agree to indemnify, defend, and hold harmless Playersbest and its affiliates, officers, employees, agents, and licensors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

9. Modifications to the Services and Terms

1. Services: We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time with or without notice.
2. Terms: We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., by email or within the App). Your continued use of the Services after the changes take effect constitutes your acceptance of the revised Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Playersbest regarding your use of the Services.
